Congressional Hispanic Caucus Chair Barragán Statement on President Biden’s Final H2-A Rule for Temporary Farmworkers

Congressional Hispanic Caucus Chair (CHC) Nanette Barragán (CA-44) released the following statement in response to President Biden’s final H-2A rule to strengthen protections for temporary farmworkers on April 26, 2024.

“I applaud the Biden and Harris Administration, Acting Secretary Julie Su, and the U.S. Department of Labor for its new rule aimed at bolstering protections for farm workers within the H-2A program. This initiative underscores a commitment to safeguarding the rights and well-being of agricultural workers, who are integral to our food supply and communities. The rule, including enhanced self-advocacy rights, transparency in labor recruitment, and clarification on termination policies, marks significant strides in fortifying worker protections and preventing abuses. By prioritizing worker safety, fair treatment, and program integrity, this rule aligns with our values of equity and justice in the workforce.

The CHC will continue to support the Biden and Harris Administrations’ dedication to ensuring the dignity and rights of all farmworkers. We look forward to the positive impact this rule will have on the lives of farmworkers across the nation.”

The Department of Labor announced a final rule, “Improving Protections for Workers in Temporary Agricultural Employment in the United States” (“Farmworker Protection Rule”), strengthening protections for agricultural workers. This page summarizes important changes to H-2A program obligations for employers and will be updated as additional resources become available. The Farmworker Protection Rule also changed the Wagner-Peyser Employment Service regulations, which are summarized here.
