Fullerton City Council voted to issue an amicus brief in support of the ACLU lawsuit Perdomo v. Noem on August 19, 2025, after two hours of public comments in support. Anaheim and several other cities signed on in October. However, Fullerton has still taken no action to date.
Update (1/28/26) from Baron j. Bettenhausen of Jones Mayer, Fullerton City Attorney’s Office:
“While we were preparing the Amicus Brief, the Supreme Court issued a ruling relevant to the Perdomo case. As a result, the Perdomo appeal was stayed and the matter was returned to the District Court for further proceedings. Since then, discovery and other proceedings have been conducted in the District Court but no new injunction has been issued. There is nothing currently pending in either court for which we can file an Amicus brief but we are continuing to monitor the case for an opportunity to file such a brief in the future.”

| Last June, the federal government unleashed heavily armed immigration agents onto the streets, worksites, and neighborhoods to abduct, disappear and detain thousands of our immigrant community members throughout Southern California. As a response, the ACLU SoCal and partners filed Vasquez Perdomo v. Noem on July 2, 2025. This landmark litigation aims to end the unconstitutional stops and arrests and ensure due process and access to counsel rights for people in immigration detention.
