The Fullerton City Council expressed its intention to support the American Civil Liberties Union (ACLU) lawsuit, Perdomo v. Nome, by voting on August 19, 2025, to issue an amicus brief. This decision followed two hours of public comments from community members who strongly supported the initiative. However, that action has not yet been implemented.
Baron J. Bettenhausen, a partner at the law firm Jones Mayer, addressed the reasons behind the delay. “While we were preparing the Amicus Brief, the Supreme Court issued a ruling relevant to the Perdomo case,” he explained. “As a result, the Perdomo appeal was stayed, and the matter was returned to the District Court for further proceedings.”
Bettenhausen noted that since the Supreme Court’s involvement, discovery and other judicial proceedings have continued in the District Court. However, no new injunction has yet been issued. “Currently, nothing is pending in either court for which we can file an amicus brief,” he added. “Nonetheless, we are actively monitoring the situation for a future opportunity to submit our support.”
The community remains hopeful for a resolution, as interest in the case continues to grow.
